(1) In any case before the court, if the plaintiff and the defendant make a written request to the court stating that the plaintiff has withdrawn his claim or the defendant wants to settle by mutual consent, the court will make a settlement regardless of the state of the case.
(2) There shall not be any kind of customs duty or penalty when settlement is made in accordance with sub-rule (1).
